Terms of Service

1. Introduction and Acceptance

Welcome to Yaru (hereinafter referred to as "the Software", "the Service"). These Terms of Service (hereinafter referred to as "these Terms") constitute a legal agreement between you (an individual or entity, hereinafter referred to as "User" or "you") and the Yaru Development Team (hereinafter referred to as "Developer", "Team", or "we") regarding your use of the Yaru application, website (yaru.asaka.moe), and related services.

Please read these Terms carefully. By downloading, installing, registering, or using Yaru, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to any part of these Terms, please stop using the Service immediately.

2. Service Description and Changes

Yaru is an all-in-one learning tool that integrates notes, Spaced Repetition System (SRS), task management (GTD), and AI-assisted learning features.

  • Service Form: The Service is provided through mobile applications, desktop clients, and cloud synchronization services.
  • Beta Versions and Updates: You understand that Yaru may be in a stage of rapid iterative development. We reserve the right to modify, suspend, or terminate part of the Service features without prior notice (e.g., adjusting free quotas for AI features, updating the user interface).
  • Availability: While we strive to provide high availability (relying on the Cloudflare global network), we do not guarantee that the Service will be absolutely uninterrupted or error-free at all times.

3. Accounts and Security

  • Eligibility: You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service.
  • Account Security: You are responsible for safeguarding your login credentials (username, password). We are not liable for any account compromise or data loss resulting from your failure to protect your credentials.
  • Authenticity: You agree to provide true and accurate information upon registration. It is strictly prohibited to impersonate others or use offensive language as a nickname.

4. User Content and Data Ownership

Yaru adopts a "Local-First" architecture, which means we deeply respect your data sovereignty.

  • Ownership: You retain ownership of all content you create, upload, or store in Yaru (such as notes, cards, tasks, hereinafter referred to as "User Content"). We do not claim ownership of your content.
  • License Grant: To provide you with cloud synchronization, AI analysis, and cross-device services, you grant us a worldwide, royalty-free, non-exclusive license to transmit, store, and process your content solely as necessary to provide the Service.

BYOS (Bring Your Own Storage) Special Disclaimer

If you choose to use the BYOS feature (such as configuring your own S3 bucket, WebDAV, or other private clouds), Yaru operates solely as a client tool. The Yaru Development Team is not responsible for any data loss, leakage, or damage caused by your configuration errors, server failures, or issues with third-party storage providers.

5. User Conduct

You agree not to engage in the following activities while using the Service:

  • Illegal Use: Using the Service to publish or transmit any content that violates local laws and regulations.
  • Reverse Engineering: Attempting to decompile, disassemble, or reverse engineer the source code of the Software.
  • Resource Abuse: Engaging in any behavior that could harm, disable, or overburden the Cloudflare edge nodes or our servers (e.g., DDoS attacks, malicious crawlers).
  • API Abuse: Attempting to bypass our paywalls, API rate limits, or accessing the Service through unofficial interfaces.

6. Special Terms for AI Features

Yaru integrates third-party AI services (e.g., OpenAI, Gemini, DeepSeek). Regarding AI features, you acknowledge and agree that:

  • Accuracy Disclaimer: AI-generated content is produced by probabilistic models and may contain errors, misleading information, or fabricated facts (hallucinations). You should verify the accuracy of AI-generated content independently and should not rely on it as the sole basis for professional fields such as medical, legal, or financial advice.
  • Input Responsibility: You must not input text containing sensitive personal privacy, national secrets, or content that infringes on the intellectual property rights of others into the AI features.

7. Payments and Subscriptions

  • Payment Processing: Our paid services may be processed through third-party payment gateways (e.g., Aifadian, Stripe, App Store In-App Purchases).
  • Refund Policy: For digital goods, refunds are generally not provided except as required by law. If the Service is completely unusable due to technical reasons, please contact customer support.
  • Price Adjustments: We reserve the right to adjust future subscription prices but will notify you in advance.

8. Intellectual Property

Except for "User Content," all rights to the Software (including but not limited to code, interface design, the "Yaru" trademark, logo, and algorithms) are owned by the Yaru Development Team and are protected by copyright laws and international treaties. You may not copy, modify, or distribute any part of the Software without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

IN NO EVENT SHALL THE YARU DEVELOPMENT TEAM OR ITS SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, OR DAMAGE TO GOODWILL).

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO YARU IN THE 12 MONTHS PRIOR TO THE DATE OF YOUR CLAIM (IF ANY). IF YOU ARE A FREE USER, THE LIABILITY CAP IS $100 (OR EQUIVALENT LOCAL CURRENCY).
